Spain Entrepreneur Visa

The Spain Entrepreneur Visa is Spain’s residency for innovative business projects of special economic interest, under the Entrepreneurs Law (Law 14/2013) as amended by the 2022 Startup Law. It is processed by a specialised unit, not the ordinary immigration offices, and decided in weeks rather than months. The file depends on a favourable report from ENISA, the public company that assesses innovation and scalability — not profitability or capital.

Who it is for

  • Founders of technology, digital, industrial or scalable service projects.
  • Startups certified under the Startup Law, and founding teams relocating together.
  • Projects with a clear innovation component — product, process, business model or market — and growth potential beyond one location.

What’s included

  • Incorporation of your Spanish limited company (SL), with notary and registry fees — see Limited Company (SL) Incorporation.
  • A business plan prepared to ENISA’s evaluation criteria, and management of the ENISA favourable report.
  • Your residency application and the residency applications of your family members.

Not included

  • Sworn translations, apostilles and legalisations of documents.
  • Government fees and administrative charges (tasas).
  • The company’s share capital, which remains the company’s own money.
  • The Beckham regime application — see Beckham Regime Applications.
  • Ongoing accounting and tax filings for the company — see Accounting & Tax — Companies.
  • A contentious-administrative appeal before the courts (recurso contencioso-administrativo), which is quoted separately.

How we work

  • 01 · Initial assessment. A candid assessment: many projects are better served by Self-Employed Visa (Cuenta Propia). We tell you which route suits your project before you spend on a plan.
  • 02 · Strategy and document map. Founder profiles, financial projections and supporting evidence, and the personal documents for each family member.
  • 03 · Preparation and filing. Business plan prepared to ENISA’s criteria, the ENISA report, then the residence application at the UGE-CE from Spain or a visa at the consulate from abroad.
  • 04 · Approval, TIE and settling in. Company incorporation, TIE cards for the whole family and registration of the activity.
  • 05 · Obligations and renewals. We keep the activity and the company’s filings in order so the authorisation can be renewed while the activity continues.

What ENISA evaluates

  • The professional profile of the founder, and of every partner if there are several.
  • The business plan: the product or service, the market, the competitive advantage, the investment needed and how it will be financed.
  • The added value for Spain: innovation, scalability, job creation and investment potential.

Why founders choose it

  • Speed and legal certainty: a 20-working-day deadline with positive silence.
  • The whole family moves at once, with the right to work.
  • A three-year authorisation from the outset, renewable while the activity continues.
