Non-Lucrative vs Digital Nomad: Which Route Is Yours
Two routes, one decision. It turns on where your income comes from, not on which looks easier.
Most people arrive at this decision with the thresholds already memorised and the important question unasked. Both routes lead to legal residency in Spain for you and your family. They differ in what they require, how long they last, and what they permit you to do once you arrive. This guide compares them on the 2026 figures and sets out the single question that should determine your choice.
The Question That Decides Everything
Both routes lead to legal Spanish residency for you and your family. They are not interchangeable, and the choice is not about which is easier. It turns on one question: does your income come from work you actively perform, or from assets you already hold?
Answer that honestly and the route selects itself. Answer it loosely and you build a file for the wrong permit.
What Each Route Requires in 2026
Non-Lucrative Residency. The 2026 IPREM stands at €600 per month, €7,200 per year on a twelve-payment basis, unchanged since 2021 because national budgets have been rolled over. The main applicant evidences 400%: €28,800 per year, plus €7,200 per family member. Funds may be savings, pensions, rental income or investment income — but not work performed in Spain.
Digital Nomad. Royal Decree 126/2026 of 18 February set the minimum wage at €1,221 per month over fourteen payments, an annual €17,094. The threshold is 200% of that annualised over twelve months: €2,849 per month, or €34,188 per year. Add €1,069 per month for a first family member and €356 per month for each further one.
Duration: The Difference People Underestimate
The Non-Lucrative Residency grants one year initially, renewed for two and then a further two — the 1 + 2 + 2 structure reaching five years, at which point long-term residency becomes available.
An authorisation granted by the UGE under the Digital Nomad route runs three years and renews for two, and the UGE resolves in twenty working days. Consular files are resolved within three months.
In practice this means the Digital Nomad route front-loads your security. Three years without a renewal file is a materially different experience from renewing at month twelve, particularly for a family settling children into school.
Work Rights: A Hard Line
The Non-Lucrative Residency does not permit work for a Spanish employer or professional activity in Spain. Income must originate outside.
The Digital Nomad authorisation permits remote work for companies established outside Spain. If you are self-employed, the clear majority of your clients must sit outside Spain. Neither route is a general work permit, and neither allows you to take a job in the Spanish market.
Eligibility Conditions That Only Apply to One
The Digital Nomad route imposes conditions the Non-Lucrative route does not: a remote working relationship predating the application by at least three months, a company that has been trading for at least a year, and either a relevant degree or demonstrable professional experience.
The Non-Lucrative route asks none of that. It asks only that you can support yourself and will not work in Spain. For retirees, people living on investment income, and families with accumulated capital, that simplicity is the whole appeal.
Tax Position
Both routes make you a Spanish tax resident if you meet the residence tests. A special regime may allow qualifying newcomers to be taxed at a flat rate on Spanish-source employment income rather than the progressive scale, and it interacts differently with each route. Eligibility conditions are specific and the election is time-limited, so the analysis belongs at the planning stage rather than after arrival.
A Common Misreading
Neither route is a citizenship programme. Spanish nationality by residence requires ten years of legal residency as a general rule, with reductions that do not apply to Iranian, Turkish or Gulf nationals. Residency is residency; nationality is a separate process on a separate timetable, and no firm can promise it.
