Long-Term Residency in Spain for MENA Nationals: The 5-Year Milestone
How Middle Eastern and North African nationals can obtain EU permanent residency in Spain after 5 years.
After 5 years of continuous legal residency in Spain, non-EU nationals — including those from the Middle East and North Africa — become eligible for EU Long-Term Residency (Residencia de Larga Duración). This is one of the most important milestones on the path to permanent life in Spain, providing significantly enhanced rights and security.
What Is EU Long-Term Residency?
The EU Long-Term Resident Permit (also called permanent residency) is granted to non-EU nationals who have resided legally in Spain for 5 continuous years. It is valid indefinitely (with periodic renewal of the physical card) and provides rights similar to Spanish nationals: the right to live and work in Spain without restrictions, access to social services, and reduced barriers to employment.
Requirements at the 5-Year Mark
To obtain long-term residency, you must demonstrate 5 years of continuous legal residence (checking absences), stable and regular financial resources, health insurance or access to the Spanish public health system, and absence of a criminal record in Spain.
Continuous Residency: What Counts as an Absence
Temporary absences of less than 6 consecutive months do not interrupt the continuity of residency. Total absences of more than 10 months in the 5-year period can disqualify the application. We advise clients throughout their residency period on managing absences to protect their long-term residency eligibility.
Long-Term Residency vs. Nationality
Long-term residency is not the same as Spanish nationality, but it is the most important stepping stone. Permanent residents can live and work in Spain indefinitely but do not have the right to vote in general elections or hold a Spanish passport. For full EU citizenship, the 10-year nationality application is required.
Portability within the EU
One major advantage of Spanish long-term residency for MENA nationals is EU portability: after holding Spanish long-term residency for a qualifying period, you may be entitled to transfer your residency to another EU member state without starting from zero.
